Terms of Service
Last updated: [[LAST UPDATED — TO BE SET BY OWNER]]
This is a template. It has been drafted as a starting point and has not been reviewed by a lawyer. It must be reviewed and adapted by a qualified attorney in the jurisdiction the business actually operates from — and the placeholders below must be completed — before it is relied upon or before any payment is accepted under it. Nothing here is legal advice.
[[LAST UPDATED — TO BE SET BY OWNER]]— the date these terms take effect.[[GOVERNING LAW — TO BE COMPLETED BY OWNER]]— governing law and venue (see section 13).[[LIABILITY CAP — TO BE COMPLETED BY OWNER]]— the money cap in section 11.[[SUPPORT ADDRESS — TO BE COMPLETED BY OWNER]]— a monitored postal or registered contact, if section 14 requires one.
These Terms of Service ("Terms") are an agreement between you and TvBeaver ("we", "us", "our") covering your use of this website and your purchase of IPTV service credits through it.
1. Acceptance of these Terms
By creating an account, placing an order, or otherwise using the service, you agree to these Terms. If you do not accept them, do not use the service and do not place an order. If you are using the service on behalf of an organisation, you confirm you are authorised to accept these Terms for it.
2. Eligibility
- You must be at least 18 years old to create an account or buy anything from us.
- You must be able to enter into a binding contract, and you must not be barred from using a service of this kind under the law that applies to you.
- You are responsible for making sure that buying and using an IPTV service credit is lawful where you are. We do not verify that for you, and we may decline or cancel an order where we believe it would be unlawful.
- You must provide an email address you actually control, because that is how we notify you about your account and your orders.
3. Account registration and security
- You need an account to buy. Keep the email address on the account accurate and current.
- Choose a password of at least 10 characters and keep it to yourself. We store only a salted scrypt hash of it, so we can never read it or send it to you.
- You are responsible for everything done through your account. Tell us promptly at the support address in section 14 if you believe someone else has access to it.
- We may suspend an account while we investigate suspected fraud, a payment dispute, or a breach of these Terms.
- One account per person. Do not create accounts to evade a suspension or a limit.
4. What the service is, and what it is not
We are a reseller and an intermediary. We buy access to IPTV services from third-party upstream providers at wholesale and resell it to you as a prepaid service credit — a term of access, on a stated number of simultaneous streams. That is the entire product.
Stated plainly, and without qualification:
- We do not produce, host, licence, own, operate or broadcast any content. The streams are supplied by third-party upstream providers. We have no control over what they carry.
- We do not control the servers your streams come from. Availability, picture quality, the channel lineup, and any on-demand catalogue are determined by the upstream provider and can change, degrade or disappear without notice to us.
- We make no promise about uptime, channel counts, catalogue size, picture format or bitrate. We do not publish an uptime guarantee or a service-level commitment, and nothing on this website should be read as one.
- We cannot confirm the licensing position of any upstream provider's catalogue, and we make no representation about it.
You are buying access arranged through us, not a warranty about what that access will contain or how it will perform. The plan card or order page states the term and the number of simultaneous streams; those two things are what we commit to delivering.
5. Payments
- Cryptocurrency only. We accept payment in the cryptocurrencies our third-party payment processor supports. We do not accept cards, bank transfers, or cash, and we never receive or store card details, because we do not take them.
- Prices are shown in US dollars. The amount you are asked to send in cryptocurrency is quoted at checkout and is fixed for the period shown on the invoice. A new quote may differ if the market rate has moved.
- You are responsible for sending on the correct network and the correct amount. Sending on the wrong network, to the wrong address, or in the wrong coin can make the funds permanently unrecoverable, and we cannot retrieve them for you.
- You are responsible for sending enough. Withdrawal or network fees deducted before the transfer arrives are a common cause of underpayment. An underpaid order is not delivered until the shortfall is settled or an operator resolves it, and we may treat an underpayment as unrecoverable.
- Transfers are irreversible. Once a payment has been sent, it cannot be recalled by us or by you.
- We may cancel an order and refuse service if a payment is reversed, disputed, or found to come from unlawful activity.
6. Delivery and activation
- Once a payment is confirmed, we issue the line upstream and place the connection details in your account. You collect them from there.
- The time between sending a payment and confirmation depends on the coin, the network, and our payment processor. We do not promise a specific activation time.
- Where an order cannot be completed automatically, it may need to be finished by hand. When that happens we record the reason on the order in your account instead of leaving it unexplained.
- The term starts when the line is issued and is stated on the order and in your account, along with its expiry date.
- The number of simultaneous streams on your line is the number shown on the plan you bought. Exceeding it may cause the line to be refused by the upstream provider.
- If we cannot deliver a paid order at all, and no alternative line can be provided, the remedy is set out in section 8.
7. Acceptable use
You agree not to:
- use the service for anything unlawful, or in breach of any law that applies to you;
- share, publish, sell, sublicense or redistribute your connection details, or run the service as your own without our written agreement;
- exceed the number of simultaneous streams on your plan, or attempt to circumvent that limit;
- probe, scan, overload, or attempt to gain unauthorised access to our systems, our payment processor, or the upstream provider's infrastructure;
- resell the service in a way that hides who the end user is, or misrepresent the service to anyone you pass it to;
- use the service in a way that exposes us, our upstream providers or our payment processor to a claim, a penalty or a network-level block.
We may suspend or terminate an account that breaches this section, and we will normally tell you why. We may act first and explain afterwards where a delay would cause ongoing harm to us or to a third party.
8. No refunds
All payments are final and non-refundable. This applies to credit purchased for a line, to any deposit, and to any unused portion of a term. It is stated once here and once on our plan page, and the two statements do not differ:
- Cryptocurrency transfers cannot be reversed, and we do not issue refunds as a matter of discretion.
- If a paid order cannot be delivered because of a failure on our side or on the upstream provider's side, and we cannot issue a working alternative line, we will resolve it by providing the line or by extending the term. That is the remedy, in place of a refund.
- If you send funds on the wrong network, send the wrong amount, or send to an address that is not ours, we cannot recover or refund them.
- Nothing in this section removes a right you have that cannot lawfully be excluded where you live. [[ATTORNEY REVIEW — CONFIRM ANY NON-EXCLUDABLE STATUTORY REFUND RIGHT AND HOW IT INTERACTS WITH THIS SECTION]]
Because it is final, start with the shortest term that suits you rather than the longest.
9. Disclaimer of warranties
The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, and non-infringement.
In particular, and without limiting that paragraph, we do not warrant that:
- the service will be uninterrupted, timely, secure or error-free;
- any particular channel, event, category or on-demand title will be available, at any time, in any region, or at any picture quality;
- the service will work with any particular player application, device, operating system or network.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or lost goodwill, arising out of or relating to the service — including any interruption, any change to a channel lineup, or any content carried by an upstream provider.
Our total liability for all claims relating to the service is limited to the greater of (a) the amount you paid us for the order giving rise to the claim, and (b) [[LIABILITY CAP — TO BE COMPLETED BY OWNER]].
Nothing in these Terms limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence where that limitation is not permitted.
11. Termination
- You may stop using the service at any time. Because credits are prepaid and final, stopping does not create a refund right under section 8.
- We may suspend or terminate your access if you breach these Terms, if a payment is reversed or disputed, if we are required to by law, or if we cease to offer the service.
- Where we terminate for a reason other than your breach, we will try to give you reasonable notice and to let any paid term run its course.
- We may delete an account that has been inactive and holds no active line. We will email the address on the account before doing so.
- Sections 4, 8, 9, 10, 11, 13 and 14 survive termination.
12. Changes to these Terms
We may update these Terms. When we do, we will change the "Last updated" date at the top of this page, and we will email the address on your account if the change is material to an order you already hold. Changes apply to orders placed after they take effect; they do not retroactively change the term or the number of streams on a line you have already bought.
13. Governing law
[[GOVERNING LAW — TO BE COMPLETED BY OWNER]]
This placeholder is deliberate and is not valid contract text. A real governing-law and venue clause must name the country or state whose law applies and where disputes are heard. It cannot be filled in by anyone but the owner, with advice.
14. Contact
Questions about these Terms, an order, or an account go to the support address below. We answer from that address, and we do not ask for your password.
Registered business name, postal address and contact telephone: [[SUPPORT ADDRESS — TO BE COMPLETED BY OWNER]]. We have deliberately left this blank rather than publish details that are not ours.
See also the Privacy Policy, which describes the data we actually store and how to ask for a copy or deletion of it.
